If your claim is for $3,000.00 or less and the defendant resides or operates a business within the Village of Nyack, you may file your claim in the Village of Nyack Justice Court. The filing fees for Small Claims are as follows:
- $10.00: Filing fee for claims up to and including $1,000.00
- $15.00: Filing fee for claims up to and including $3,000.00

Filing fees must be paid at the time of filing. The Court accepts certified checks, money orders, or cash (exact change only). Small Claims applications must be submitted in person, Monday through Friday, between 9:00 AM and 4:30 PM.
Small Claims Court Schedule: Small Claims and other civil actions are heard approximately every other Thursday. Please confirm the exact date with the Court Clerk at 845-358-4464.
Note: Claims filed outside of the Court’s jurisdiction or filed incorrectly will not be refunded if the Justice determines a lack of judicial jurisdiction.
If your claim is settled before the hearing date, both parties must notify the Court in writing. If the claim proceeds, you must be prepared to prove your case at the hearing. This includes bringing all relevant evidence. Please bring two (2) extra copies of all documents for the Court and for the defendant.
- If using paid receipts as evidence, bring the original receipts and copies for both the Court and the defendant.
- If using estimates as evidence, bring at least two (2) written estimates and copies for both the Court and the defendant.
The Court will issue a summons and complaint on your behalf via U.S. mail. If service by mail is unsuccessful, it is your responsibility to arrange for service through a third party, with proof of the original affidavit of service.
