ETPA

The ETPA is a NYS law that authorizes municipalities to opt-in to rent regulation for certain eligible buildings. On November 9, 2023, the Village of Nyack Board of Trustees approved a resolution opting certain apartment buildings into the NYS ETPA program. The linked documents below provide further information about this program, including the board resolution, the NYS fact sheet, a rental vacancy report documenting the rental housing emergency and a further rental market analysis.  After further evaluation, the VON vacancy survey of 2023 did not establish a vacancy rate sufficient to opt into the ETPA, but the VON continues to work on affordable housing policy, including possible future adoption of the ETPA.
